1. Overview
These Terms and Conditions govern your access to and use of Dealdog, a communication platform provided by Dealdog ("we," "us," or "our"). Dealdog enables authorized car dealership salespeople to communicate with vehicle shoppers who have voluntarily provided their phone numbers via dealership websites, forms, or other lead capture channels.
By creating an account, accessing the platform, or sending any message through Dealdog, you agree to be bound by these terms. If you do not agree, you must not use the service.
2. What Dealdog Does
Dealdog provides car dealerships and their authorized sales staff with Twilio-hosted phone numbers to make and receive phone calls and exchange text messages with sales leads. Leads are individuals who have explicitly provided their phone number to the dealership through a web form, chat widget, or other opt-in channel.
Dealdog does not generate leads, scrape contact data, or purchase phone lists. Every number in the system originates from a direct, consumer-initiated inquiry to the dealership.
3. Eligibility and Account Responsibilities
Dealdog accounts may only be created and used by authorized employees or contractors of a licensed car dealership. You agree to provide accurate, current, and complete information during registration and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must immediately notify us of any unauthorized use or security breach.
4. Acceptable Use
You agree to use Dealdog solely for legitimate, dealership-related communication with leads who have provided their contact information. Specifically, you may not:
- Send unsolicited messages to individuals who have not provided their phone number to your dealership.
- Use Dealdog for telemarketing, spam, or any purpose unrelated to the sale or service of vehicles.
- Transmit unlawful, fraudulent, defamatory, threatening, harassing, or otherwise objectionable content.
- Attempt to reverse engineer, scrape, or interfere with the platform or its underlying infrastructure.
We reserve the right to suspend or terminate any account that violates these rules without prior notice.
5. Messaging Compliance
Dealdog operates in compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable carrier guidelines including A2P 10DLC registration requirements. All outbound messaging is conducted via registered A2P 10DLC campaigns with full opt-in documentation.
- Every message sent through Dealdog must relate to an existing lead relationship initiated by the consumer.
- You must honor all opt-out requests immediately upon receipt.
- Message content must be professional, truthful, and relevant to the lead's expressed interest.
6. Service Availability and Limitations
We strive to maintain high uptime for Dealdog, but we do not guarantee uninterrupted service. Maintenance windows, third-party carrier issues, or other factors outside our control may cause temporary service interruptions.
Dealdog is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Dealdog shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of your use of or inability to use Dealdog. Our total liability for any claim arising out of or relating to these terms shall not exceed the amount you paid us for Dealdog in the twelve (12) months preceding the claim.
8. Termination
We may suspend or terminate your access to Dealdog at any time, with or without cause, and with or without notice. Upon termination, all licenses and rights granted to you under these terms will immediately cease.
You may also terminate your account at any time by contacting us. Sections that by their nature should survive termination shall survive, including but not limited to liability limitations and indemnification obligations.
9. Governing Law and Disputes
These Terms and Conditions are governed by the laws of the State of Delaware, without regard to its conflict of laws principles. Any dispute arising from these terms shall be resolved exclusively in the state or federal courts located in Delaware.
10. Changes to Terms
We may update these Terms and Conditions from time to time. We will notify you of material changes by posting the updated terms on this page with a revised "Last updated" date. Your continued use of Dealdog after such changes constitutes your acceptance of the new terms.
